Terms and Conditions Governing the Online Purchase of RBC Products

U.S. Import & Export Regulations

Purchaser will pay all handling and other similar costs from Company’s factories including the costs of freight, insurance, export clearances, import duties and taxes. Purchaser will be “exporter of record” with respect to any export from the United States of America and will perform all compliance and logistics functions in connection therewith and will also comply with all applicable laws, rules and regulations. Purchaser understands that Company and/or the products or services are subject to laws and regulations of the United States of America which may require licensing or authorization for and/or prohibit export, re-export or diversion of Company’s products or services to certain countries, and agrees it will not knowingly assist or participate in any such diversion or other violation of applicable United States of America laws and regulations. Purchaser agrees to hold harmless and indemnify Company for any damages resulting to Purchaser or Company from a breach of this paragraph by Purchaser.

Price

Prices for RBC’S products are stated on the Site, however, if costs increase, or if the price stated on the Site is inaccurate, RBC may bill at prices in effect at the time of shipment. You have the right to cancel your order within 10 days upon receipt in writing of notice from us regarding increased prices.

Returns

RBC products may not be returned for credit without the express written permission of RBC. Products accepted for return will be subject to inspection and restocking charges which will be determined on a case-by-case basis.

Labor Laws

To the best of RBC Bearings’ knowledge, information and belief, the products mentioned will be manufactured in conformity with state and federal laws relating to wages and hours and age limits of employees, and in conformity with any applicable state and federal legislation.

Warranty

RBC’s sole warranty is against defects in material and workmanship. This warranty is exclusive and in lieu of all other warranties (whether written, oral or implied) including, but not limited to, any warranties of merchantability, except as set forth above, and warranties of fitness for a particular purpose. A no charge replacement will be made of any RBC product which, upon examination by RBC, appears to be defective, provided such product is returned to us, transportation prepaid, within 90 days of the date of sale, and further provided that the product has been properly selected, used, including properly mounted and lubricated and not subject to abuse. RBC Bearings’ liability shall be limited to replacement of such defective bearing. RBC shall not be liable for any other damages either direct, or consequential.

Special Bearings and Products

RBC may undership or overship any order for special bearings to the extent of ten percent, the purchaser agreeing to pay in full for such overshipment or to consider the delivery completed with such undershipment.

Delivery of Products

Product deliveries are subject to deferment due to breakdowns, strikes, acts of GOD or other unforeseen circumstances. When commitments have been made by RBC for materials, or when materials have been put into production for products for the specific use of the customer, delivery may not be deferred by the customer without the express written permission of RBC.

Cancellation

No part of an order is subject to cancellation without the express written consent of RBC. Once accepted cancellations of orders are subject to charges to be determined on a case-by-case basis.


Governing Law and Jurisdiction

This Site and all aspects of your use of this Site shall be governed, construed, and interpreted in accordance with the laws of the state of Connecticut.

General Terms

This Agreement sets forth the entire understanding between you and RBC Bearings with respect to the subject matter hereof and supersedes all prior written or oral understandings, communications, or agreements not specifically incorporated herein. Any failure of RBC Bearings to enforce or exercise any provision of this agreement shall not constitute a waiver of that provision. If you access the Site from a location outside of the United States you are responsible for compliance with all local laws.

Nothing in this agreement is intended to or shall exclude, modify, or restrict the operation of any applicable statute or other law, the provisions of which cannot be lawfully excluded or restricted, including where applicable the statutory rights of consumers provided for under relevant national laws or the laws of the European Union. However, if any court of competent jurisdiction determines that any limitation of liability, disclaimer, or other provision of this agreement is illegal, invalid, or unenforceable in any jurisdiction, then such provision shall be deemed to be modified to the minimum extent necessary to make it comply with the applicable statute or law of such jurisdiction, and the remaining provisions of this agreement shall continue in full force and effect.

RBC's obligation to sell products is subject to its review of compliance with law.
